Welcome to Buy Me A Rose. By accessing or using our website, mobile application, or services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms constitute a legally binding agreement between you and Buy Me A Rose ("we," "us," or "our"). We reserve the right to update these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

Buy Me A Rose is a creator support platform that enables supporters to send "roses" (monetary contributions) to creators. The Service facilitates:

• One-time monetary contributions ("roses")
• Recurring monthly subscriptions
• Purchasing digital goods and extras from creators
• Commissioning custom content through requests
• Engaging with creators through posts, comments, and shoutouts
• Creator-to-creator gifting and support

3. Account Registration and Responsibilities

3.1 Account Creation

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be at least 18 years old or the age of majority in your jurisdiction

3.2 Account Security

You are responsible for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to maintain account security.

4. Fees and Payment Terms

Buy Me A Rose charges a 5% platform fee on all transactions. In addition, payment processing fees charged by Stripe (typically 2.9% + $0.30 per transaction) apply.

All fees are clearly disclosed before you complete a transaction. Creators receive the remaining amount after platform and processing fees are deducted.

5. Intellectual Property Rights

Creators retain all rights to their content. By posting content, creators grant Buy Me A Rose a limited license to display, distribute, and promote that content on the platform.

Supporters may not copy, distribute, or create derivative works from creator content without explicit permission.

6. Prohibited Activities

You may not use the Service to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Engage in fraudulent activities
• Harass, threaten, or abuse others
• Post illegal, hateful, or explicit content
• Impersonate others or provide false information
• Interfere with the Service's operation

7. Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms, fraudulent activity, or other reasons we deem necessary to protect the Service and its users.

8. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE ARE NOT LIABLE FOR ANY DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.

9. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Your continued use after changes take effect constitutes acceptance.
