3. Where to Send DMCA Notices

4. Our Response to DMCA Notices
Upon receiving a valid DMCA notice, we will:

- Notify the user: Inform the user who posted the content that it has been removed
- Document the complaint: Keep records of all DMCA notices

5. Counter-Notification
If you believe your content was removed in error or you have authorization to use the material, you may file a counter-notification.
5.1 Counter-Notice Requirements
Your counter-notification must include:

5.2 Counter-Notice Process
After receiving a valid counter-notification:
- We will forward the counter-notice to the original complainant
- The complainant has 10-14 business days to file a lawsuit
- If no lawsuit is filed, we may restore the content after 10-14 business days
6. Repeat Infringer Policy
Buy Me A Rose has a policy of terminating, in appropriate circumstances, accounts of users who are repeat copyright infringers.
6.1 What Constitutes a Repeat Infringer
A user may be considered a repeat infringer if:
- They have received multiple valid DMCA takedown notices
- They repeatedly post infringing content after warnings
- They have a pattern of ignoring copyright law
6.2 Consequences
For repeat infringers, we may:
- Issue warnings and educational materials
- Temporarily suspend account privileges
- Permanently terminate the account
- Ban the user from creating new accounts
7. Misrepresentations
Under the DMCA, anyone who knowingly materially misrepresents that:

- Material or activity was removed or disabled by mistake or misidentification
May be liable for damages, including costs and attorney's fees.
Do not make false claims. You could be sued for damages and attorney's fees if you knowingly misrepresent infringement.
8. Before Filing a DMCA Notice
Before submitting a DMCA takedown notice, please consider:
- Fair Use: Is the use transformative, educational, or otherwise protected by fair use?
- Permission: Did you grant permission for this use that you may have forgotten?
- Public Domain: Is the work actually in the public domain?
- Direct Contact: Can you resolve this by contacting the user directly?
